1. About these Terms
These Terms of Service govern your access to and use of the website, customer portal, APIs, proxy services, and related services operated by Smolux Technology Limited (“we,” “us,” or “our”).
By accepting these Terms when registering or purchasing services, you agree to these Terms, our Acceptable Use Policy, and our Refund Policy. Our Privacy Policy explains how we handle personal information.
If you use our services on behalf of an organization, you confirm that you have authority to act for that organization.
2. Eligibility and account responsibilities
You must be at least 18 years old and legally capable of entering into an agreement to use our services.
You must provide accurate account and business information and keep it reasonably up to date. Where verification is required for a service, you must complete that verification before accessing the relevant functionality.
You are responsible for protecting your passwords, API keys, proxy credentials, and other access information. Notify customer support promptly if you suspect unauthorized access.
For organization or team accounts, administrators are responsible for managing membership and permissions. Actions taken by authorized members, including purchases and renewals, may affect the organization’s shared balance and services.
3. Our services
We provide proxy access and related account, connection, and management functionality. Available products, locations, protocols, service periods, traffic allowances, and optional features are described in the applicable offer and order confirmation.
Only features expressly included in your purchase form part of that purchase. Availability may vary by product and location.
Proxy services depend on network conditions, upstream infrastructure, and destination websites. Unless expressly agreed otherwise, we do not guarantee uninterrupted access, a particular connection speed, acceptance by every destination website, or the continued availability of a particular IP address.
These limitations do not excuse a failure to provide the service we agreed to supply or restrict your statutory remedies.
4. Orders, prices, and payment
The price, currency, service period, and applicable charges displayed when you confirm an order govern that order. Future pricing changes do not retrospectively increase the price of an accepted order.
You authorize us to deduct the confirmed amount from your prepaid balance or charge the payment method you authorize.
A prepaid balance represents credit for purchasing our services. Promotional credits, coupons, and referral rewards are subject to the conditions disclosed when they are offered and are distinct from funds you have paid.
Renewals require your authorization. Any automatic renewal arrangement must be separately disclosed and accepted before it is enabled.
5. Acceptable use
You must comply with our Acceptable Use Policy and applicable laws. You are responsible for having the necessary rights, permissions, and legal basis for your activities, including accessing third-party systems and collecting or processing personal information.
Purchasing proxy access does not grant permission to access another person’s account, bypass access controls unlawfully, or use third-party content without authorization.
6. Refunds
Our Refund Policy forms part of these Terms.
You are entitled to a full refund of the amount paid for a transaction if customer support receives your refund request within 24 hours after successful payment. Ordinary activation or use during that period does not reduce the refund.
The Refund Policy explains how to request a refund and what happens to the related services.
7. Suspension and termination
We may restrict or suspend access where reasonably necessary to address suspected unauthorized access, unlawful activity, a material breach of these Terms, nonpayment, a legal requirement, or an immediate risk to our services or other people.
Where practicable, we will explain the reason and give you an opportunity to resolve the issue. Immediate suspension may be necessary where delay would increase the risk or where disclosure is legally restricted.
You may stop using our services and request account closure through customer support. Account closure does not automatically cancel outstanding payment obligations or remove records we must lawfully retain.
Suspension or termination does not automatically forfeit your paid balance or remove refund rights. Any retention, deduction, or recovery of funds must have a contractual and lawful basis.
If we permanently discontinue a prepaid service before its agreed expiry for reasons unrelated to your breach, we will refund the unused portion unless you agree to a suitable alternative.
8. Intellectual property
We and our licensors retain ownership of the website, software, branding, documentation, and other materials we provide.
You receive a limited right to access and use them as necessary to use the purchased services. You must not copy, distribute, sell, or exploit them beyond that permission or any rights provided by law.
You retain your rights in information and materials you provide. We may process them only as necessary to provide the services and for the purposes described in our Privacy Policy.
9. Responsibility and liability
Each party is responsible for losses caused by its breach of this agreement to the extent required by applicable law.
For business customers, to the extent permitted by law, neither party is responsible for indirect or consequential losses, and our aggregate liability arising from the affected service is limited to the fees paid for that service during the 12 months preceding the event giving rise to the claim.
This limitation does not limit our obligation to pay refunds or return funds properly owed to you. It also does not exclude liability for fraud, intentional misconduct, gross negligence, personal injury, or any other liability that cannot lawfully be excluded or limited.
Nothing in these Terms removes mandatory consumer rights.
10. Changes to these Terms
We may update these Terms to reflect changes to our services, operations, or legal obligations. We will provide reasonable notice of material changes before they take effect, except where an urgent legal or security requirement requires a shorter period.
Changes will not retrospectively remove accrued rights or reduce refund rights for completed purchases. Where your agreement is legally required, we will obtain it.
11. Governing law and disputes
These Terms are governed by the laws of Hong Kong, subject to any mandatory protections that apply to you, including applicable protections in mainland China.
Please contact customer support about a dispute so that we can attempt to resolve it. You are not required to complete an informal complaint process before exercising a statutory right.
Subject to mandatory rules on jurisdiction, disputes may be brought before the competent court at the company’s registered domicile. Nothing in this section prevents you from using a court, regulator, or dispute-resolution procedure available to you under mandatory law.
